On December 10, 2019, Democrats on the House Judiciary Committee announced that they would levy two articles of impeachment, designated H. Res. 755: (1) abuse of power, and (2) obstruction of Congress, in its investigation of the President's conduct regarding Ukraine.

For the third time in history, the House has voted to impeach the president of the United States. On December 18th, 2019, the House voted to pass both of its two articles of impeachment brought against President Donald Trump.

The first — one charging the president with abusing his power — passed 230-197, with two Democrats voting no. Democratic presidential hopeful Tulsi Gabbard voted present.

The second article the House adopted accuses Trump of obstructing Congress. The final vote was 229-198, with three Democrats voting no and Gabbard again voting present. Both are tied to the Ukraine scandal and Trump’s urging of the Ukrainian president to investigate his political rival, former Vice President Joe Biden, and his son, Hunter.

Articles of Impeachment

  • Article I, abuse of power, addresses Trump’s general underlying conduct in the Ukraine scandal. It alleges that Trump abused his power by trying to pressure Ukraine’s government into announcing an investigation into the Bidens by withholding both a White House meeting and military aid.

  • Article II, obstruction of Congress, is about how Trump responded to Democrats’ impeachment inquiry over the Ukraine scandal. It alleges that Trump obstructed the probe by urging witnesses not to cooperate and government agencies not to comply with subpoenas.

Article I, “Abuse of Power,” focuses on the underlying facts of the Ukraine scandal. It asserts that Trump: “Corruptly solicited the Government of Ukraine to publicly announce investigations” into his political rival Joe Biden, and into “a discredited theory” that Ukraine interfered with the 2016 election. Attempted to condition two “official acts” on this announcement — a White House meeting with Ukraine’s president, and the release of $391 million of blocked military aid for Ukraine.

Article II, “Obstruction of Congress,” states that President Trump “has directed the unprecedented, categorical, and indiscriminate defiance of subpoenas issued by the House of Representatives pursuant to its ‘sole Power of Impeachment.’”

Specifically, the article goes on, Trump:

- Directed the White House to defy a subpoena for documents
- Directed other executive branch agencies, such as the State Department and Defense Department, to defy subpoenas
- Directed current and former executive branch officials to refuse subpoenas for their testimony.“

This abuse of office served to cover up the President’s own repeated misconduct and to seize and control the power of impeachment,” Article II reads. Therefore, both articles conclude, Trump should be removed from office and barred from holding any future office.
